The general conditions of sale

1. Presentation

Any online purchase made on the www.exploreloirevalley.com site is subject to prior knowledge and acceptance of these general conditions of sale.

2. Definitions

Article: product of any kind offered for sale (book and service) on the Site.

Customer: non-commercial natural person making the Reservation or Order and holding full legal capacity

Order: commitment to purchase all the Items selected by the Customer via the Site's e-commerce service

Site: website published by Toni Pastre and Candy Pastre on behalf of Candy PASTRE and accessible at the address www.exploreloirevalley.com

3. Preamble

These general conditions of sale (hereinafter "GTC") apply exclusively between any Customer and theCandy Pastre Companywhose registered office is located at 20 rue du moulin à vent, 41350 Saint Gerais-la-forêt, France, registered in the Paris Trade and Companies Register under number 903547206

The T&Cs are applicable without restriction or reservation to all the Items offered for sale on the Site.

The applicable GCS are those appearing on the Site on the day of the Customer's Order.

Any order on the Site is subject to prior consultation and unreserved acceptance by the Customer of these T&Cs and the applicable prices.

The Customer's "click" on the "Payment" button accessible on the page dedicated to the validation of the Order or the Service provision constitutes acceptance.

These T&Cs prevail over any other document.

4. Disclaimer

Any customer declares to be informed of the lack of reliability of the Internet network, especially in terms of relative security in the transmission of data, non-guaranteed continuity in access to the Site, non-guaranteed performance in terms of volume and speed of transmission data and the spread of viruses.

TheCandy Pastre Society  warns each Customer of the need to implement within their computer or portable or mobile equipment a security solution and measures to prevent the spread of viruses.

5. Creation of a Customer account

Placing an order or booking a service on the site requires the prior creation of a customer account.

Anyone can freely and free of charge create a Client account via the “Create an Account” section.

The creation of a Customer account is carried out by completing the form which is proposed to the user of the Site.

This account is strictly personal to him and allows him to identify himself before validating each Order.

When creating the Customer Account, the Customer enters the data that allows his identification under his full responsibility, controls and directions and undertakes to communicate complete, accurate and up-to-date information, and not to usurp the identity of a third parties, nor to mask or modify its age.

When creating a Customer Account, the Customer chooses his username (e-mail) and his password.

If the selected identifier is already assigned, the system prompts him to choose another one.

Usernames and passwords are personal and confidential. Si Candy Pastre Company  takes all necessary precautions and undertakes to protect the personal data of its Customers, the Customer is informed of the need to keep his password secret and not to disclose it to a third party , in any capacity whatsoever.

In the event of suspicion of the use of the username and password by a third party, the Customer must immediately alert Société Candy Pastre in order to change his password and/or choose to have his Customer Account closed.

Candy Pastre Company reserves the right to close any Customer Account and consequently refuse any sale to a Customer in the event of non-payment of one or more previous orders or services.

In this case, Société Candy Pastre sends an e-mail to the Customer concerned at the address communicated by the latter when creating his Customer Account informing him of the deactivation of his username and password and the closing of his Customer Account. A notice period of eight (8) calendar days is granted to the Customer so that he can submit his observations to Société Candy Pastre, without prejudice to the suspension of his Account during the notice period. In general, the Customer is informed that his Account may be closed following the Customer's first request sent by e-mail to the Candy Pastre Company.

6. Characteristics of the Items

The Items available for sale are those which appear on the Site. The offers are valid as long as they are visible on the Site.

They are offered within the limits of the availability displayed on the Site.

The Candy Pastre Company reserves the right to withdraw from sale, at any time, any Article or Service present on the Site and/or to replace or modify any information associated with the Articles / Services appearing on this Site.

In the event of the unavailability of an Item after placing his Order or the Cancellation of a service related to the unforeseen events mentioned during the reservation, the Customer is informed by e-mail, his Order or Service being then automatically cancelled, the Candy Pastre Company undertakes to reimburse it as soon as possible and at the latest within 14 days following the cancellation of the order or to propose the postponement of the service if desired.

The characteristics of the Items sold on this Site (photographs, graphics and descriptions of the Items, etc.) may vary over time. Only the visual of the Article displayed at the time of the Order must be taken into account by the Customer.

7. Ordering Items

Any Order implies a payment obligation.

The Customer declared to be at least 18 years old and to have legal capacity, or if he is a minor guarantees to hold parental authorization to place his Order.

To place an Order, the Customer must follow the online purchase process and click on “Order” to submit the Order.

The payment of the Order implies acceptance of these GCS, the price of the Items and the content of the Order.

After validation of the payment, Société Candy Pastre sends the Customer an e-mail confirming his Order.

All Orders are subject to the prior acceptance of the Company Candy Pastre and are definitively confirmed only after the receipt by the Customer of an e-mail confirming the dispatch of the Item(s).

If the Customer does not receive any e-mail following his Order or Service, it is his responsibility to contact customer service in accordance with the procedures described in article 12 of these GCS.

 Société Candy Pastre cannot be held responsible in the event of an input error or transmission of an input error attributable to the Customer and not allowing the delivery of the e-mail. of confirmation and/or of the Order.

It is recommended that the Customer print the Order confirmation email.

For any question relating to the follow-up of an Order, the Customer must consult his customer account on the Site or contact customer service according to the methods described in article 12 of these GCS.

8. Price of Items

The prices are indicated on the Site in euros, all taxes included (TTC) excluding participation in shipping costs and any taxes in the country of destination.

They take into account the VAT and any reductions applicable on the day of the Order.

Any new taxes or contributions, in particular environmental, are likely to be passed on up or down on the sale price of the Items.

The prices of the Items are exclusive of delivery costs (postage, packaging, and making of the parcel according to the amounts in force).

The Candy Pastre France Company reserves the right to modify the prices of the Articles at any time, the Articles being invoiced on the basis of the prices in force at the time of the validation of each Order.

The amount of the shipping costs is specified on the Site before validation of the order.

The price of the Items invoiced is therefore that indicated at the time of the Order.

9. Payment of the Order or Reservation

Any Order or Reservation implies an obligation to pay by credit card using a sufficiently funded bank account. The Order or Reservation is not final until full payment of the price and costs associated with the Order or Reservation.

The price invoiced to the Customer is the price indicated in the confirmation of the Order or Reservation sent to the Customer by e-mail.

The order or service is payable immediately by credit card (CB, Visa, MasterCard, American Express).

It is possible for the Customer to save his bank details on his account. The data in this case remains encrypted and not accessible.

Transactions made on the Site are entrusted to a secure online payment platform Paypal.

10. Terms of delivery

The Customer can follow the progress of his package on the carrier's website.

The Customer is informed that it is his responsibility to provide exactly all the details necessary for the proper delivery of his Order and for perfect delivery (access code, access specifications, for example).

If the Customer is absent at the time of delivery, a delivery notice informs the Customer of the terms and conditions for the conservation of his package and its availability, under the full and exclusive responsibility of the carrier.

The Customer fully and exclusively assumes the risk of loss or damage to the Items from the time of their delivery.

11. Delivery times

The Articles are delivered to the delivery address indicated by the Customer when placing the Order at the latest at the end of the period indicated when placing the Order, depending on the country of delivery.

The Candy Pastre Company undertakes to ensure that the delivery is made within a maximum period of thirty (30) calendar days from the Order.

In the event of a delay in delivery in relation to the aforementioned maximum period, the Customer may contact the company's representative to order him to carry out the delivery within a reasonable additional period. In the event of non-compliance with this new deadline, the Customer may, by e-mail or letter, terminate the contract and obtain a refund for his Order.

The contract and therefore the sale will be considered terminated upon receipt by the Company Candy Pastre of the e-mail or a letter by which the Customer informs it of its decision unless the delivery has taken place between sending and receiving the Customer's e-mail or letter.

In the event that the Order is definitively cancelled, the Customer will obtain reimbursement of the price paid for his Order within 14 days of the date of termination by the Customer.

Each delivery is deemed to have been made as soon as the package is made available to the Customer, in particular by the carrier, materialized by the control system used by the carrier.

If the package is damaged or if the Item does not correspond to the Customer's Order, the Customer must initiate the return procedure described in Article 11 below within 15 calendar days after dispatch.

12. Right of withdrawal and procedures for returning the Book

Under Directive 2011/83/EU of the European Parliament and of the Council of October 25, 2011 on consumer rights and law number 2014-344 of March 17, 2014, as transposed in Articles L. 221-18 et seq. of the Consumer Code, any consumer in the European Union is entitled to cancel his Order at any time within 14 calendar days following the date on which he received the Item(s) and this without having to give reasons or to pay penalties. The article here being a book, must be in perfect condition and return in the best conditions in order to be able to offer this article again for sale.

To exercise his right of withdrawal, the Customer must notify the Company Candy Pastre of his decision to withdraw by means of an unambiguous declaration to the following address:

To this end, the Customer can use the Contact form on the Site.

The Customer can also send a declaration of withdrawal without any ambiguity to the following e-mail address: contact@exploreloirevalley.com. If the Customer uses this option, Société Candy PASTRE will immediately send him an acknowledgment of receipt of the withdrawal.

After having notified   the Candy Pastre Company of its withdrawal in accordance with these stipulations, the Customer must return the Item(s) concerned within a maximum period of 14 days from this notification. This deadline is deemed to have been respected if the Customer returns the Article(s) concerned before the expiry of the 14-day period.

Any withdrawal made beyond the 30-day period mentioned above cannot be accepted.

Only a new, unused and unsoiled Item will be refunded..The item must be returned in its original packaging, or, failing that, in packaging guaranteeing equivalent protection,accompanied by any label.

The return can be made by post, or by carrier.

Once the verification of the returned Item(s) has been carried out, the Candy Pastre Company undertakes to reimburse the Customer as soon as possible following notification of the withdrawal request. In the absence of receipt of the Article(s) concerned or proof of shipment within this period, the Candy Pastrese Company reserves the right to postpone the refund until the day of recovery of the Article(s). ) concerned or the provision by the Customer of proof of shipment of the Article(s) concerned.

All sums paid for the Article concerned will be refunded to the Customer (with the exception of additional costs resulting from the fact that the Customer has chosen, where applicable, a delivery method other than the less expensive delivery method standard proposed by the Company Candy Pastre on the bank account or the payment account of the Customer used for the payment of the Item(s) under his Order.

13. Right of withdrawal and terms of service provision (exit)

Any outing reserved on the site must be paid for in advance.No payment will be accepted on the day of release. In the event of exceptional events organized within the Saint Louis Cathedralat the scheduled time (baptism, funeral, wedding, etc.)these events may lead to the cancellationof the exit. You will then be offered a postponement or a refund. Any delay of more than 15min at   the scheduled time of the appointment, must be notified.Beyond the 30 min delay or cancellation the day before or the D-day, without justification or valid reason, the service is due and therefore not reimbursed.

16. Liability

The Candy Pastre Company reserves the right to modify the information contained in the Site at any time and without notice.

Société Candy Pastre to describe with the greatest accuracy the Items sold on the Site and to ensure, in the best possible conditions, the updating of the information which is disseminated there.

The Customer acknowledges and accepts that the prices of the Items are likely to vary between the Website and the stores (independent bookstores for example), and that in no case can this price difference be the basis for a request for reimbursement, either total or partial, Items purchased, either on the Site or in stores, outside of its right of withdrawal under the conditions provided for in Article 11 of these GCS.

The responsibility of the Company Candy Pastre can not be retained in case of breach of one of these contractual obligations resulting from a fortuitous event or a case of force majeure as defined by the case law rendered by the French courts. Force majeure is an external, unforeseeable and irresistible event.

In particular, the Company Candy Pastre will not be held responsible for any non-execution or delay in the execution of Orders caused by events beyond its control (“Cases of Force Majeure”)

A Case of Force Majeure includes any act, event, non-performance, omission or accident beyond the control of the Company Candy Pastre and includes in particular (non-exhaustive list):

1. Strikes, closures or other industrial or social actions.

2. Civil unrest, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or not) or threat or preparation for war.

3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters.

4. Impossibility of using transport by rail, boat, plane, road or other means of private or public transport.

5. Inability to use public and private telecommunications networks.

6. Acts, decrees, laws, regulations, or restrictions of any government.

7. Strikes, failures or accidents in maritime, postal or other transport.

The execution of the T&Cs will be suspended for as long as the Case of Force Majeure lasts and the execution and delivery deadlines will be extended accordingly.
The Candy Pastre Company will endeavor as far as possible to put an end to the Case of Force Majeure or to find a solution allowing it to perform its contractual obligations despite the Case of Force Majeure.

17. License

The Candy Pastre Company grants the Customer a license limited to personal use of the Site, excluding any professional or commercial use of the Site.

Under no circumstances is the Customer authorized to download or modify all or part of this Site without the prior, written and express authorization of the Candy Pastre Company.

This Site or any part of this Site must under no circumstances be reproduced, copied, sold, downloaded, modified or exploited for commercial or professional reasons without the prior, written and express authorization of the Company Candy Pastre.

The Customer must not use techniques allowing the copying of a brand, logo or any other information (in particular images, texts, models) of which the Company Candy Pastre is the owner or licensee, without its prior express written consent.

the Candy Pastre Company authorizes the Customer, on a non-exclusive and revocable basis, to create a hypertext link pointing to the home page of the Site on the condition that this link cannot harm the interests of the Candy Pastre Company. The fact of inserting a hypertext link which could suggest that the Articles would present an infringing nature could in particular harm the interests of the Candy Pastre Company.

Under no circumstances may the creation of this hypertext link engage the responsibility of the Candy Pastre Company, in any capacity whatsoever.

20.Cookies

This “Cookies” section allows you to find out more about the origin and use of the navigation information processed when consulting our Site and about the rights of users.

Thus, during the consultation of the Site, information relating to navigation is likely to be recorded in “Cookies” files installed on the user's terminal (computer, tablet, smartphone, etc.).

21. Intellectual property, domain name and website

The Candy Pastre Company is the holder of an exclusive license of the intellectual property rights on the following elements, without this list being exhaustive.

• On the Articles offered on the Site and on the brands associated with the Articles.

• On the site, and in particular on its tree structure, on the organization and title of its sections, on the visual and graphic identity, on its design, on its ergonomics, its functionalities, on the software, texts, images, animated or fixed, sounds, know-how, drawings, graphics, and any other element composing the Site

• On the databases, their structure, and their content, designed and managed by Jasper Peto France for the needs of publishing the Site

• On all design elements of the Site whether graphic or technical

• On the names, acronyms, logos, colors, graphics or other signs that could be used, produced or implemented by the Candy Pastre Company.

The Candy Pastre Company also holds the exclusive license for the exploreloirevalley.com domain names. Since December 2022, Explore Loire Valley is also a registered trademark.

It is therefore prohibited to reproduce in any form whatsoever, directly or indirectly, the elements referred to in this article, as well as to alter the trademarks, patents, names, acronyms, logos, colors, graphics or other signs. appearing on the elements made available within the Site, and more generally to use or exploit these elements other than within the framework of the execution of the present.

As such, the reproduction or use of all or part of these elements is only authorized for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited.

22. Modification of the T&Cs

Given the possible evolutions of the Site and the regulations, the Company Candy Pastre reserves the right to modify the GCS at any time. Only the GCS in force at the time of the conclusion of the contract will be binding on the Customer.

The new T&Cs will, where applicable, be brought to the attention of the Customer by modifying the dedicated page of the Site. The Customer expressly consents to the new version of the GCS by validating a new order.

The latest version of the GCS can be downloaded on a reliable and durable medium from the dedicated page of the Site and according to the methods indicated in the preamble.

23. Governing law. Mediation disputes.

These T&Cs are subject to French law.

In the event of a dispute, the Customer will first contact the Candy Pastre Company to seek an amicable solution by contacting via the form.

After prior written action by the Customer vis-à-vis the Company Candy Pastre, a mediator service may be contacted for any consumer dispute whose settlement has not been successful. The European Commission has set up an online dispute resolution platform. Any dispute will fall under the exclusive jurisdiction of the French courts of the Customer's place of residence, in the absence of an amicable agreement between the Customer and the Candy Pastre Company.
